1. Introduction
Welcome to ealani.com (“we”, “us”, “our”). By accessing or using our website, mobile application, or any related services (collectively, the “Platform”), you agree to be bound by these Terms of Use (“Terms”). If you do not agree to these Terms, you must immediately cease using the Platform.

ealani.com operates as a free classified and listing platform that connects buyers and sellers within the United Arab Emirates (“UAE”). We act solely as a neutral intermediary and digital platform and we do not participate in, endorse, or guarantee any transactions between users. All interactions and transactions occur directly between users, and we bear no responsibility for them.

These Terms incorporate by reference our Privacy Policy, Cookie Policy, Community Guidelines, Listing & Advertising Policy, Safety Tips, Prohibited Items & Content Policy, and Law Enforcement & Data Request Policy (collectively, the “Policies”). We recommend reviewing all Policies before using the Platform.

2. Eligibility
To use the Platform, you must:

  • Be at least 18 years old.
  • Have the full legal capacity to enter into binding agreements.
  • Use the Platform in full compliance with all applicable UAE laws and regulations

We reserve the right to refuse access to anyone who does not meet these criteria or violates these Terms.

3. Nature of Our Service
ealani.com is a neutral intermediary platform as defined under applicable UAE laws. We are not a party to any transaction and have no control over the quality, safety, morality, legality, or completion of any listings or dealings between users. Buyers and sellers are independent and solely responsible for all aspects of their dealings, including due diligence, payment, delivery, and disputes

  • We provide a digital space for users to post, browse, and interact with listings.
  • We do not own, sell, inspect, verify, or endorse any items or services listed.
  • We do not guarantee the accuracy, completeness, quality, safety, or legality of any user-generated content, listings, or transactions.
  • All transactions, communications, and disputes are solely between buyers and sellers. Users must conduct their own due diligence, including verifying identities, inspecting items, and using secure methods.
  • We may facilitate communication tools, but we do not monitor or guarantee the security of such communications.
  • The Platform is provided “as is” and “as available” without warranties of any kind, express or implied, to the fullest extent permitted by UAE law.

4. User Accounts
To access certain features, you must create an account. You agree to:

  • Provide accurate, current, and complete information during registration and keep it updated.
  • Maintain the security and confidentiality of your login credentials (e.g., username, password).
  • Be solely responsible for all activities, postings, and transactions occurring under your account, including any unauthorized use.
  • Notify us immediately of any suspected breach or unauthorized access.

We may suspend, terminate, or restrict your account at any time, without notice or liability, if we suspect violations of these Terms, our Policies, or UAE laws, including fraud, misuse, or security risks. Terminated users may not create new accounts without our express permission.

5. User Responsibilities
As a user, you agree to:

  • Post lawful, accurate, honest, and non-misleading listings, including clear descriptions, pricing in UAE Dirhams (AED), and real photos.
  • Communicate respectfully, professionally, and without harassment.
  • Avoid any fraudulent, deceptive, or misleading behavior, including false advertising or scams.
  • Comply fully with all UAE laws, including the E-Commerce Law, Consumer Protection Law, Cybercrimes Law, PDPL, and regulations on content, commerce, intellectual property, and cyber security.
  • Conduct due diligence on other users before transacting, including verifying listings and using our Safety Tips.
  • Report any suspicious or illegal activity to us promptly.
  • Not use the Platform for any purpose that could harm us, other users, or the community.

You are solely responsible for your content, actions, or legal obligations arising from your use of the Platform.

6. Prohibited Activities
In addition to our Prohibited Items & Content Policy, you must not:

  • Post, promote, or engage in illegal, restricted, or prohibited items, content, or services under UAE law (e.g., narcotics, weapons, counterfeit goods, pornography, gambling).
  • Engage in fraud, impersonation, scams, phishing, or any deceptive practices.
  • Upload viruses, malware, or harmful software; attempt to hack, breach, or disrupt our systems; or engage in cyber attacks.
  • Post adult, explicit, or suggestive content or services prohibited in the UAE.
  • Infringe intellectual property rights (e.g., copyrights, trademarks) of others.
  • Harvest, scrape, or collect data about users without their explicit consent.
  • Bypass content blocks, promote criminal skills (e.g., bomb-making, lock-picking), or trade in boycotted goods.
  • Create multiple accounts to manipulate listings or evade restrictions.
  • Use automated tools (e.g., bots) to post or interact without our approval.
  • Violate any export controls, sanctions, or anti-money laundering laws.

Violations may result in content removal, account suspension, legal action, and reporting to UAE authorities.

7. Content Ownership

  • You retain ownership of the content you post (e.g., listings, photos, messages).
  • By posting content, you grant us a worldwide, non-exclusive, royalty-free, perpetual license to use, display, reproduce, modify, distribute, and store it solely for Platform operations, moderation, and legal compliance.
  • You represent that your content does not infringe third-party rights and complies with UAE laws.
  • We reserve the right, but are not obligated, to monitor, review, screen, edit, or remove any user-generated content at any time and for any reason, including but not limited to content that we determine, in our sole discretion, violates these Terms, UAE law, or is otherwise harmful, objectionable, or inaccurate. Our failure to act in a particular instance does not waive our right to act with respect to that instance or any other instances.

8. Payments
The Platform is currently free to use. If we introduce optional paid features (e.g., premium listings), we will provide separate terms and obtain your consent. All fees will be clearly displayed in AED, with no hidden charges, in compliance with the Consumer Protection Law.

9. Limitation of Liability
To the maximum extent permitted by UAE law, the Platform is provided “as is” and “as available” without warranties of merchantability, fitness for a particular purpose, or non-infringement. We disclaim all liability for:

  • Any losses, damages, or claims arising from user-to-user transactions, including fraud, defects, or non-delivery.
  • Inaccurate, misleading, or illegal listings or content.
  • Interruptions, errors, viruses, or technical issues with the Platform.
  • Third-party actions, including data breaches or misuse by users.
  • Indirect, consequential, punitive, or incidental damages, even if advised of the possibility.

Users are solely responsible for conducting all necessary due diligence, verification, and background checks before entering into any transaction. We recommend you review our Safety Tips before engaging with other users.

10. Indemnity
You agree to indemnify, defend, and hold ealani.com harmless, its affiliates, officers, directors, employees, and agents from any claims, losses, damages, liabilities, costs, or expenses (including legal fees) arising from:

  • Your use or misuse of the Platform.
  • Your violation of these Terms or Policies.
  • Your breach of UAE laws or third-party rights.
  • Any content you post or transactions you engage in.

11. Termination
We may suspend, terminate, or restrict your access at any time, without notice, for reasons including:

  • Violations of Terms, Policies, or UAE laws.
  • Illegal, fraudulent, or abusive activity.
  • Security risks or repeated complaints.
  • Inactivity or at our sole discretion.

Upon termination, your license to use the Platform ends, and we may delete your content. Sections surviving termination include disclaimers, limitations, indemnity, and governing law.

12. Miscellaneous

  • Severability: If any provision is invalid, the remainder remains enforceable.
  • Entire Agreement: These Terms and Policies constitute the full agreement, superseding prior versions.
  • Force Majeure: We are not liable for delays due to events beyond our control (e.g., natural disasters, cyber attacks).
  • No Waiver: Failure to enforce a right does not waive it.
